Terms & Conditions

1. Acceptance of these terms

These Terms & Conditions (the “Terms”) form a binding agreement between you and TruGenetics LLC (“Tru-Genetics,” “we,” “our,” or “us”). They apply to your use of thetrugenetics.com, order.thetrugenetics.com, and clinic.thetrugenetics.com (the “Websites”) and to every order you place through them.

By browsing the Websites, completing an assessment, or submitting an order, you confirm that you have read these Terms and agree to be bound by them, together with our Refund Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Websites or place an order.

Separately, before payment you will be asked to review and sign a purchase agreement covering your specific order. That signed agreement is also incorporated into these Terms, and where it addresses the same subject in more detail, it governs your order.

2. Who may use our services

You may use the Websites and place orders only if you are at least 18 years of age, reside in the United States, and are legally capable of entering into a binding contract. Our services are intended for your own personal use and may not be used to obtain medication for another person.

You agree to provide accurate and complete information, including your legal name, date of birth, biological sex, and shipping address, and to keep that information current. Inaccurate information may delay or prevent medical review, and may result in denial of service.

Not every medication is available in every state. Availability is determined at checkout and confirmed again during medical review, and a protocol may be declined or modified based on where you live.

3. What Tru-Genetics does — and does not — do

Tru-Genetics operates a technology platform that connects patients with independent licensed medical providers and with licensed compounding pharmacies. We are not a medical practice, a pharmacy, or an insurer. We do not practice medicine, make clinical decisions, prescribe, or dispense medication.

The providers who evaluate you exercise their own independent medical judgment. A provider-patient relationship begins only when a licensed provider accepts and reviews your case — not when you create an account, complete an assessment, or submit payment.

Our services are not for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not wait for a response from us or from your provider.

4. Medical review and prescriptions

Before any order is fulfilled, you must complete the required medical evaluation and a licensed prescriber must approve a prescription in your name. We cannot and do not guarantee that a prescription will be issued, that a particular medication will be approved, or that a protocol you selected will be the one your provider recommends.

Your provider may request additional information, adjust your protocol, or decline to prescribe. Prescriptions are written for a limited duration and must be renewed through a new order and provider review.

Blood work

Certain protocols require baseline laboratory work before a prescription can be issued, and periodic laboratory work while you continue treatment. Where blood work is required, your order will not move to fulfillment until results are received and reviewed by your provider.

Optional consultations

You may add a one-on-one consultation with a specialist at checkout. Consultations are optional, are not a substitute for your provider’s medical review, and do not guarantee approval of any protocol.

5. Compounded medications

Medications ordered through the Websites are compounded preparations — prepared by a licensed compounding pharmacy specifically for you, in the strength and formulation stated on your prescription. They are not mass-produced, commercially manufactured, or stock shelf products.

Because each preparation is made for one identified patient, pharmacy laws and regulations prohibit it from being returned to stock, resold, reused, or transferred to anyone else. Once your order enters compounding, it has no value or lawful use for any person other than you.

Compounded preparations are not FDA-approved products. They are prepared by pharmacies operating under sections 503A and 503B of the Federal Food, Drug, and Cosmetic Act and are dispensed only against a valid prescription. Individual responses to treatment vary, and no particular outcome is promised or implied.

6. Orders, pricing, and payment

Prices are listed in U.S. dollars and may change at any time before an order is placed. You are responsible for the full amount of your order, including any applicable fees, taxes, and shipping charges.

When you pre-authorize payment, you are authorizing us to charge the card or other payment method you provide for the full amount of your order. You confirm that you are the authorized holder of that payment method. In some cases an amount is held at the time of order and captured once your prescription is approved.

That payment authorization becomes irrevocable when your order is submitted. You remain responsible for the full amount even if you later change your mind, refuse delivery, or stop treatment. If a payment is declined or reversed, we may suspend fulfillment until the balance is resolved.

7. Refunds, cancellations, and disputes

Because every medication is compounded for one patient and cannot lawfully be returned or reused, all sales are final and orders cannot be canceled once payment is pre-authorized. The only refund we issue is where a licensed prescriber declines to approve your prescription.

Our full terms on refunds, cancellations, blood panels and consultations, damaged or incorrect shipments, and payment disputes are set out in our Refund Policy, which forms part of these Terms.

8. Shipping and delivery

Approved orders ship in climate-controlled packaging designed to keep temperature-sensitive medications stable in transit. Depending on your protocol, your order may arrive in more than one shipment and from more than one pharmacy, so part of your order may be delivered before the rest.

Delivery timeframes are estimates, not guarantees, and can be affected by medical review, laboratory turnaround, pharmacy processing, and carrier delays. You are responsible for providing a correct, deliverable address and for arranging safe and prompt receipt of your package. We are not responsible for loss, theft, or temperature exposure after a carrier records a package as delivered. If an item arrives damaged or does not match your prescription, see our Refund Policy for how to report it.

9. Reorders and continuing treatment

Prescriptions are written for a limited duration. To continue a protocol beyond that period, you must place a new order and be reviewed again by a licensed provider, who may request updated laboratory work before renewing. Reorders are subject to these Terms as they exist at the time the new order is placed, and to the same refund and cancellation rules.

10. Your responsibilities

  • Use your medication only as prescribed, and only for yourself.
  • Never share, sell, or transfer your medication to another person.
  • Disclose your medical history, current medications, and allergies accurately and completely.
  • Store your medication as directed, including refrigeration where required.
  • Report side effects or adverse reactions to your provider promptly, and seek emergency care when warranted.
  • Keep your account credentials secure. You are responsible for activity that occurs under your account.

11. Acceptable use of the Websites

You agree not to misuse the Websites — including by attempting unauthorized access, interfering with their operation or security, scraping or harvesting data, submitting false or misleading information, impersonating another person, or using the Websites for any unlawful purpose. We may suspend or terminate access for any violation.

12. Intellectual property

All content on the Websites — including text, protocol descriptions, graphics, photography, logos, and underlying software — belongs to Tru-Genetics or its licensors and is protected by intellectual property laws. You may view and print content for your personal, non-commercial use. Any other copying, reproduction, modification, or distribution requires our prior written permission.

13. Third-party services

The Websites work alongside services we do not control, including payment processors, laboratories, pharmacies, patient portals, and shipping carriers. We are not responsible for the content, availability, or practices of those services, and your use of them may be subject to their own terms.

14. Electronic communications and signatures

You consent to receive agreements, notices, disclosures, and other communications from us electronically. You agree that checking an acknowledgment box and submitting an order constitutes your electronic signature, carrying the same legal effect as a handwritten signature under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state law. A copy of any agreement you sign is available on request.

15. Text messages

If you provide a mobile number, we may text you about your order, laboratory status, and refills, and — with your opt-in — occasional promotional messages. Message frequency varies and message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. Mobile numbers and messaging consent are never sold or shared with third parties for their own marketing.

16. Privacy

How we handle your information is described in our Privacy Policy. Health information you share with a licensed provider is governed by our Notice of Privacy Practices.

17. Disclaimer of warranties

To the maximum extent permitted by law, the Websites, products, and services are provided “as is” and “as available.” Tru-Genetics disclaims all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty regarding the results, outcomes, or effectiveness of any medication or treatment.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under the law of your state.

18. Limitation of liability

To the maximum extent permitted by law, Tru-Genetics and its officers, members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, data, or goodwill, arising from your use of the Websites, products, or services. Our total aggregate liability for any claim will not exceed the amount you paid for the order giving rise to that claim.

These limits do not apply to the professional conduct of licensed providers or pharmacies, who are independently responsible for their own services, and do not limit liability that cannot lawfully be limited.

19. Indemnification

You agree to indemnify and hold harmless Tru-Genetics and its officers, members, employees, and contractors from any claims, damages, losses, liabilities, and reasonable attorneys’ fees arising from your breach of these Terms, your misuse of any medication, or your provision of inaccurate or incomplete information.

20. Governing law and dispute resolution

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Before filing any claim, you agree to contact us at support@thetrugenetics.com and to attempt in good faith to resolve the matter informally for at least thirty (30) days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction and venue there.

21. Changes to these terms

We may revise these Terms at any time. The effective date at the top of the page reflects the current version, and revisions apply to orders placed after they are posted. Continuing to use the Websites after a revision is posted means you accept the updated Terms.

22. General provisions

These Terms, together with our Refund Policy, the purchase agreement you sign for your order, the Privacy Policy, and the Notice of Privacy Practices, are the entire agreement between you and Tru-Genetics on this subject. If any provision is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms; we may assign ours in connection with a merger, acquisition, or sale of assets.
